1. Acceptance of Terms

By accessing and using the NOVARC Media website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

NOVARC Media provides professional video production, filmmaking, brand storytelling, post-production, and related creative services. The specific scope of services will be defined in individual project agreements.

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information for your project
• Respond to requests for feedback and approvals in a timely manner
• Provide necessary materials, access, and permissions for project completion
• Pay all agreed-upon fees according to the payment schedule
• Respect intellectual property rights and licensing agreements

4. Intellectual Property Rights

Ownership: Upon full payment, clients receive the agreed-upon usage rights to the final deliverables. NOVARC Media retains ownership of raw footage, project files, and preliminary materials unless otherwise agreed in writing.

Portfolio Use: NOVARC Media reserves the right to use completed projects in our portfolio, marketing materials, and promotional activities unless otherwise agreed.

Third-Party Content: Clients are responsible for obtaining all necessary rights, licenses, and permissions for any third-party content included in their projects.

5. Payment Terms

• Project fees and payment schedules will be outlined in individual project agreements
• A deposit is typically required to commence work
• Additional costs for scope changes or revisions beyond agreed terms may apply
• Late payments may result in project delays or suspension of services
• All fees are in the currency specified in the project agreement

6. Project Timeline and Deliverables

Project timelines are estimates and depend on client feedback, approvals, and cooperation. Delays caused by the client may result in adjusted timelines. We strive to meet all agreed deadlines but are not liable for delays beyond our reasonable control.

7. Revisions and Changes

The number of revision rounds will be specified in the project agreement. Additional revisions or significant scope changes may incur additional fees. Major changes after production has commenced may affect timeline and budget.

8. Cancellation and Refunds

By Client: Cancellation fees apply based on project stage. Deposits are non-refundable. Clients are responsible for payment of all work completed up to cancellation date.

By NOVARC Media: We reserve the right to cancel projects with full refund of payments received if we cannot deliver the agreed services.

9. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the project. This obligation continues after project completion.

10. Limitation of Liability

NOVARC Media's liability is limited to the total fees paid for the specific project. We are not liable for indirect, incidental, consequential, or punitive damages. We do not guarantee specific business results from our services.

11. Warranties and Disclaimers

We warrant that our services will be performed professionally and with reasonable skill. However, creative services are subjective, and we cannot guarantee that deliverables will meet all expectations or achieve specific business outcomes.

12. Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, war, pandemics, or government actions.

13. Governing Law

These Terms of Service are governed by the laws of Poland. Any disputes will be resolved in the courts of Warsaw, Poland.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of modified terms.
